SAN FRANCISCO, California, JUNE 1, 2004 (Zenit.org).- A federal judge said the ban on partial-birth abortion, signed into law last year, is unconstitutional.
U.S. District Court Judge Phyllis Hamilton said today the law was unconstitutional because it was vague and posed an "undue burden" on abortion "rights."
She also ruled against the law because it lacked an exemption to protect a mother's health.
U.S. Senate Majority Leader Bill Frist, a key backer of the ban, said he was disappointed by the ruling but predicted it would eventually be overturned, Reuters reported.
